Musical Captions

Terms of Service

Last updated: October 8, 2026

These terms are an agreement between you and Toot Your Own Horn, LLC, a Nevada company ("we", "us"). They cover your use of Musical Captions at app.musicalcaptions.com (the "Service"). By signing in or paying, you agree to them.

1. What you're buying. A membership gives you access to the Service, a web app you use in your browser while your membership is active. You aren't buying software or a copy of the app. Access ends when your membership ends.

2. Your account. Members sign in with their Whop account. You can also make a free account by signing in with Google or with a one-time code we email you. Keep your sign-in secure. The free version is a limited version of the Service at no charge (for example, shorter videos with a small watermark, 3 watermarked exports in total, and a small AI allowance); we can change or end it at any time. Memberships are for one person; don't share your sign-in or resell access. You must be at least 13. If you're under 18, a parent or guardian has to agree to these terms for you.

3. Billing. Memberships are billed by Whop, our payment processor, at the price shown when you buy (currently $17 a month or $147 a year for Musical Captions Creator, and $47 a month or $470 a year, billed annually, for Musical Captions Autopilot). They renew automatically until you cancel. The first 100 paying Autopilot members keep their founding rate while their subscription stays active. Whop's own terms also apply to payments. We may change prices for future billing periods; we'll tell you before a change affects you, and you can cancel before it does.

4. Cancelling and refunds. You can cancel anytime from your Whop account. You keep access until the end of the period you've paid for. See the Refund Policy for refunds.

5. Your music. You own what you upload or create: your scores, recordings, videos and projects. Only upload music you have the right to use. By uploading, you confirm you have the right to upload what you upload. You give us the permission we need to run the Service for you (for example, to process a score when you ask the AI to change it). You also let us use the scores you upload, save or make in the app to train and improve Musical Captions. We never share or publish your music. You can turn this off anytime in the app: Settings, Privacy, "Use my uploads to improve Musical Captions". You're responsible for how you use and share what you make, including any copyright in the music.

6. The AI assistant. Some features use AI. Your membership includes a monthly AI allowance, shown in the app. AI suggestions can be wrong. Check the results before you rely on them, especially for teaching. What you type to the AI assistant, and crash reports when something in the app breaks, are saved to improve Musical Captions (see the Privacy Policy).

7. Fair use. Don't misuse the Service: no breaking, overloading, scraping or reverse engineering it, no getting around the sign-in or the AI allowance, and nothing illegal. We may suspend or end access for serious or repeated misuse.

8. Changes and availability. We improve the Service often, which means features can change. We aim to keep it running, but we can't promise it will always be available or error free. Keep your own copies of anything important (the app lets you save projects and export videos).

9. Our stuff. The app, its design, looks, sounds and code belong to us or our licensors. Your membership doesn't transfer any of that to you.

10. Liability. The Service is provided "as is". To the fullest extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you is limited to what you paid us in the 12 months before the claim.

11. Changes to these terms. If we change these terms in a way that matters, we'll update the date above and tell you in the app or by email. Continuing to use the Service means you accept the new terms.

12. Law. Nevada law governs these terms. Disputes go to the courts in Clark County, Nevada, unless the law where you live says otherwise.
